Ordinance For the Replacement of Trees Removed During New Construction
ORDINANCE NUMBER 331
AN ORDINANCE TO ADD CHAPTER 36 TITLE III OF THE CITY OF MARYSVILLE CITY CODE TO PROVIDE FOR THE REPLACEMENT OF TREES REMOVED DURING NEW RESIDENTIAL (SPECIFICALLY , ZONING DISTRICTS R1-A, R1-B, AND R1-C) CONSTRUCTION ACTIVITY.
The City of Marysville finds that growth and the spread of development have had the effect of eliminating many trees in the City. Specifically, the City finds:
|a.||That trees protect the public health through the absorption of air pollutants and contamination, by the reduction of excessive noise and through their cooling effect in the summer months;|
|b.||That trees are an essential component of the general welfare of the City by maintaining natural beauty, recreational opportunities, wildlife habitat, and irreplaceable heritage for existing and future City residents;|
|c.||That trees play a role in filtering waste water which passes through the ground from surfaces to groundwater tables and lower aquifers.|
|d.||That trees, through their root systems, stabilize the soil and play an important and effective part in City-wide soil conservation, erosion control and flood control.|
|e.||That trees appreciably reduce carbon dioxide content and increase oxygen content of the air and play a vital role in purifying the air.|
THE CITY OF MARYSVILLE ORDAINS:
Chapter 36 is hereby added to Title III of the Marysville City Code as follows:
CHAPTER 36 TREE REPLACEMENT
The following definitions shall apply in the interpretation of this Chapter:
3.6.3 Deposit Required.
Whenever a person shall engage in activity as defined in this section, said person shall first place on file with the Department a deposit of $400.00, which deposit shall be held by the department as follows:
|a.||At the expiration of twelve (12) months from the date of the issuance of the Permanent Occupancy Permit the person shall supply evidence of the two (2) trees required by this section to be planted, having been planted and the Department upon inspection determines that the trees are alive and healthy and that the requirements of this ordinance have been complied with, the Department shall refund the deposit.|
|b.||If at the expiration of the twelve (12) months no such evidence of compliance with the terms of this ordinance shall have been received by the Department, the Department shall remit the said deposit to a city account which use shall be solely for the purchase of and planting of trees in the City of Marysville.|
This ordinance shall take effect January 1, 1995 after adoption and publication in accordance with law.
